Non-Admitted Status

An admitted insurer is licensed to transact insurance business in the insured’s home state. A non-admitted insurer is not licensed to transact insurance business in the insured’s home state. Surplus lines insurance is a mechanism that allows United States consumers to purchase property-casualty coverage from non-admitted insurers when consumers are unable to purchase the coverage they need from admitted insurers. Typically, coverage must be declined by three admitted insurers before coverage can be placed with a non-admitted insurer. Generally, non-admitted insurers are free from regulatory oversight of policy forms and rates. It is this freedom that permits non-admitted insurers to provide unique coverages and rating plans that are otherwise not available to consumers through admitted insurers.

The state insolvency or guarantee funds were established to provide the public with protection from insolvent insurers. These guarantee funds do not apply to non-admitted insurers except in New Jersey where a separate guarantee fund was established for policies written by non-admitted insurers.

Maxum Indemnity Company is a surplus lines insurer. The company is an admitted insurer in Delaware and an eligible non-admitted insurer in 49 states and U.S. territories. Currently, Maxum Indemnity Company is not an eligible non-admitted insurer in Delaware and New Hampshire.

Maxum Casualty Insurance Company is an approved admitted insurer in 50 states and domiciled in Delaware.
